01

Acceptance of Terms & Definitions

These Terms of Service govern all freight forwarding, parcel express shipping, warehouse storage, customs clearance, and digital tracking services offered by UPEX Logistics.

"Shipment" means all packages, parcels, pallets, or cargo tendered to UPEX under a single waybill or tracking identifier.
"Waybill" includes any physical or electronic shipping label, air waybill (AWB), or consignment note generated by UPEX.
"Shipper" refers to the individual or legal entity requesting shipping services.
02

Scope of Express & Freight Services

UPEX provides international and domestic courier services through multimodal transport (air freight, ocean cargo, and ground express fleets).

  • Estimated Transit Times: Quoted delivery dates are estimates calculated based on normal operational conditions. Severe weather, customs holds, or force majeure events may alter delivery times without defaulting contract terms.
  • Volumetric Billing: Charges are calculated based on the greater of actual gross weight (kg) or dimensional volumetric weight \((L \times W \times H / 5000)\).
03

Prohibited & Restricted Items

The shipper warrants that no package tendered contains hazardous or prohibited goods under IATA, ICAO, or national transport regulations.

Strictly Prohibited Goods Include:

• Explosives, Ammunition & Firearms
• Illegal Narcotics & Controlled Substances
• Hazardous Chemicals & Corrosives
• Counterfeit Currency & Bearer Bonds
• Lithium Ion Batteries (Uncertified)
• Perishable Foods (Non-Cold Chain)
04

Customs Duties, Taxes & Inspection

International shipments are subject to import customs inspection, duty assessments, and regional taxes.

  • Duty Responsibility: Unless explicitly agreed under DDP (Delivered Duty Paid) terms, all import duties, tariffs, and customs clearance fees are the sole responsibility of the recipient.
  • Right to Inspect: UPEX and authorized customs officials reserve the right to open and inspect any package without prior notice for safety and regulatory verification.
05

Limitation of Liability & Insurance Claims

UPEX’s standard carriage liability for verified loss or physical damage is limited strictly to the lower of declared value or US $100 per shipment, unless additional declared value insurance was purchased at shipment creation.

Claims Submission Deadlines:

Damaged Shipments Must be filed within 14 calendar days of parcel delivery with original packaging photos.
Non-Delivered / Lost Parcels Must be reported within 30 calendar days from expected delivery date.
07

Governing Law & Jurisdiction

These Terms of Service are governed by and construed under international commercial carriage laws and maritime trade standards. Any legal disputes arising from transportation contracts shall be submitted to binding arbitration in the registered jurisdiction of UPEX Logistics.
